PRIVACY POLICY

  1. Introduction

    This Privacy Policy (”Policy”) explains how First Pass Innovation Inc., the entity behind Code Blue Leader App (”First Pass”, ”we ,”, ”our”, or ”us”) collects, stores, uses, and distributes information, including Personal Information, when users, including Institutional Users (”Users”, ”you”, ”your”) download, access and use our mobile application (”App”). For the purposes of this Privacy Policy, “Personal Information” means any information related to an identifiable individual or that may be used to identify an individual.

    We may change this Privacy Policy from time to time. We encourage you to review this Privacy Policy each time you use the App to see if the policy has been changed, as indicated by the “Last Updated” date set out above. Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted and any material changes will become effective thirty (30) days from the date the change is posted.

  2. DISCLAIMER

    OUR APP MAY ONLY BE USED BY ADVANCED CARDIAC LIFE SUPPORT-LICENSED HEALTH CARE SERVICE PROVIDERS, INCLUDING BUT NOT LIMITED TO LICENSED PHYSICIANS, REGISTERED NURSES, AND OTHER AUTHORIZED AGENTS OF HEALTH CARE INSTITUTIONS (COLLECTIVELY, ”INSTITUTIONAL USERS”). THE APP IS PROVIDED TO USERS AS A MEMORY-AID AND SUPPORT TOOL TO ASSIST WITH MANAGING PATIENT CARE. THE APP IS NOT INTENDED TO BE USED AS A SUBSTITUTE OR IN LIEU OF ANY ALREADY EXISTING PRACTICES AND METHODS USED BY INSTITUTIONAL USERS IN THE ORDINARY COURSE OF CARE. FIRST PASS IS NOT AND SHALL NOT AT ANY TIME BE RESPONSIBLE FOR ANY MEDICAL DECISION MAKING BY USERS, OR FOR ANY MEDICAL CARE PROVIDED BY INSTITUTIONAL USERS, TO PATIENTS OR OTHERWISE. THE APP AND ANY INFORMATION PROVIDED THROUGH THE APP IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT REPLACE REAL-LIFE CONTEXTUAL CLINICAL JUDGEMENT. WE MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, REGARDING THE ACCURACY, ADEQUACY, VALIDITY, RELIABILITY, AVAILABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED IN THE APP.

  3. Information We Collect

    When you use the App, we may collect information about you in the following ways:

    1. Automatically Collected Information. We automatically collect certain information about your use of the App or your device. For example, we may collect:
      • Device information such as mobile device model, IP address, device identifiers, operating system, browser type and settings (like language and available font settings) and other settings of the device you use to access the App.
      • Usage information such as the time and duration of your App use, and other information about your interaction with the App.
      • Location information such as general location derived from your mobile device’s GPS signal, or information about nearby WiFi access points and cell towers that may be transmitted when you use the App.
      We and our service providers may use cookies, web beacons, and other tracking technologies to collect such information.
    2. Information From Third-Party Sources. We may receive information about you from other sources, which we may combine with information collected from your use of the App. For example, we may receive information from:
      • Publicly and commercially available sources, as permitted by law, including contact information, professional information, and information about your respective Healthcare Institution (as applicable); and
      • Data analytics providers and advertising partners, including usage information, and information about your activity and transactions on other websites, platforms or with other companies.
    3. Other Information We Collect. We may collect other information about you, your mobile device, or your use of the App in ways that we describe to you at the point of collection or otherwise with your consent. You may choose not to provide us with certain types of information but doing so may affect your ability to use some or all aspects of the App.
  4. How We Use Information

    We may use your information as follows:

    1. To Provide and Manage the App, including but not limited to:
      • provide App access and/or enable you to use the App’s features;
      • provide customer service; and
      • understand and resolve technical issues, App crashes and other issues reported to us.
    2. To Contact You. We may periodically contact you with App-related updates, new features you are entitled to access, legal information, customer service communications, newsletters, and alerts (where applicable, based on your registrations and preferences), surveys, offers, promotions, and other information that may be of interest to you.
    3. To Better Understand Our Users and Improve our App. We analyze our Users’ interactions with the App to better understand and serve our Users and to improve our App.
    4. To Deliver and Measure Advertising, Including Personalized Advertising. We and third parties may use your information to deliver you ads, promotions, and offers that may be personalized to you, and to measure the placement, frequency, efficacy, and compliance of advertising and ad impressions (including contextual and targeted ads). The ads are for us and third-party advertisers and appear both on and off the App. We and third parties may use cookies and other tracking technologies to understand how you use the App and facilitate serving relevant ads. This helps us determine if you have seen an ad before, tailor ads to you, including based on your activity, and avoid showing you duplicate ads.
    5. To Protect the Rights of the Services and Others. We may use your information that we, in good faith, believe is necessary or appropriate to secure, protect, enforce, or defend the legal rights, privacy, safety, or property of the App, First Pass employees or agents, or other Users, and to comply with applicable law and legal process.
    6. With Consent. We may otherwise use your information with your consent or at your direction.
  5. How We Share Information

    We may share your information with:

    • Third Party Applications at your request or on your authorisation. We are not responsible for the privacy practices of these entities.
    • Affiliates within our family of affiliated companies.
    • Service Providers that we engage to provide services on our behalf, such as hosting vendors, advertising service providers, and list managers.
    • Other Parties When Required by Law or As Necessary to Protect Our Users ,including ** ** as we believe is necessary or appropriate to protect, enforce, or defend the legal rights, privacy, safety, or property of the App, First Pass affiliates, employees, agents, and other Users, or to comply with applicable law or legal process, including responding to requests from public and government authorities.
    • Third Parties that Provide Analytics, Content, Advertising, or Functionality. Third parties may collect or receive certain information about you and/or your use of the App to provide content, ads (including personalized ads), or functionality, or to measure and analyze ad performance, on our App or other websites or platforms. Such information may include device information (e.g., mobile device or device ID), usage information, or other information obtained through analytics technologies. Such third parties may combine this information with information collected across different websites, online services, and other linked or associated devices.
    • Other Parties in Connection with a Corporate Transaction. We may share information we have about you if we sell or transfer all or a portion of our business or assets to a third party, such as in the event of a merger, acquisition, or in connection with a bankruptcy reorganization, or in contemplation of or due diligence related to such a corporate transaction.
    • Otherwise With Your Consent or At Your Direction. We may also share information about you with third parties whenever you consent to or direct such sharing.

    We may also share Personal Information that does not identify Users with third parties. For example, we may share Personal Information that cannot be linked back to an identifiable individual for advertising purposes.

  6. Third-Party Content and Links

    Our App may embed content from, or link to, third-party websites and services that are outside of our control. We are not responsible for privacy practices of any such third parties. This Privacy Policy does not govern those third parties’ collection, use, processing, and disclosure of your information. Please consult the privacy policy of the respective third-party website or service to determine how they may collect, use, process, or disclose your information, including Personal Information.

  7. Data Storage and Retention

    We will keep your information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain information as necessary to prevent fraud or future abuse, legitimate business purposes, or as required by law. All retained information will remain subject to the terms of this Privacy Policy.

    Our servers and those of our sub-processors are located in Canada and/or the United States and accordingly your Personal Information may be available to the Canadian or United States governments or their agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.

  8. Access and Accuracy

    You have the right to access the information we hold about you to verify the Personal Information we have collected in respect to you, to have a general account of our uses of that Personal Information, and to update, correct, delete, or add to your Personal Information as appropriate. Upon receipt of your written request, we will provide you with a copy of your Personal Information although in certain limited circumstances, we may not be able to make all relevant Personal Information available to you (for example, where that Personal Information also pertains to another User). In such circumstances we will provide reasons for the denial to you upon request. We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and to respond to your requests to update, correct, delete, or add to your Personal Information in a timely manner. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your Personal Information.

  9. Security

    We use commercially reasonable efforts to store and maintain your information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect information that we collect about you. We have implemented procedures designed to limit the dissemination of your information only such designated First Pass employees, affiliates, third parties and sub-contractors as reasonably necessary to carry out the stated purposes we have communicated to you.
